Auto Insurance Claims: No Fault Accident, claims advice, claim help

Hello Jane,

My wife and I live in Pennsylvania. Last month a woman hit my wife's car while it was parked along the the street. No one was in the car when it was hit, and we have a police report stating that it was the other driver's fault. It turns out that the person who hit my wife's car did not have insurance.  Our insurance company made us pay our deductible to have our car fixed.  Is this correct?  It doesn't seem right to me that we have to pay money out of our pocket simply because we were unlucky enough to have an uninsured driver hit our car parked along the street.  Any help or advice you could give would be greatly appreciated.

I'm sorry to say that this is the way it works.  Regardless of the circumstances, when there is an unknown hit and run driver involved, you are always on the hook for your collision deductible.

The good news is, as long as you were legally parked this does not count as an at fault accident for you and it should not effect your rates.

Things would be near hopeless if you did not have collision coverage.  But if the deductible is too much of an expense, consider lowering it.  With a good driving record, adjusting your deductible downward should not greatly raise your rates.
