Auto Insurance Claims: hit by insured motorist but will not contact his insurance, certified mail, high mileage

Two weeks ago I was rear ended by an insured motorist in oregon. It was clearly his fault and he admitted it to me on the scene. The police were not called to the scene. Within an hour I contacted his insurance company and they started a claim. They said that they needed to contact their policy holder so they could assign blame. I have been in contact with them several times and they claim to be calling him twice a day and have sent letters, but he has not contacted them. The only witness is my nephew that was riding with me. I only have liability on my vehicle as it is older and high mileage. What are my rights if the policy holder never contacts his insurer? Are there any things that i should be doing now that will help me in the long run. If he never contacts his insurance I will probably pursue this in court even if I lose money, purely on principle. Hi Bill,

This is why you should always call the police.

Now that this is done the only thing you can do if you have the at fault drivers name and address, it to send him a letter by certified mail and regular mail telling him that if he does not contact his insurance company within 3 days that you will file suit against him personally. Then, if he does not contact his insurance company, file suit.
