Auto Insurance Claims: Insured policy claim adjuster investigation due to unlisted driver in coverage, unlisted driver


Question
What can I do to defend my claim and protect myself?
1)My truck was struck in my driveway.
2)Person driving presents insurance policy which he is not listed under.
3)Insured policy claims adjuster has now place my claim under investigation due to possible coverage issues w/unlisted driver.

Well, your best bet is to pursue the at fault party and let him do the fighting about whether or not he is covered.

In standard policies, unlisted doesn't mean much, but non-permissive is the question, but in non-standard, it is possible that unlisted is indeed "uncovered".  Some of the higher risk policies have a clause in them that says that the policy holder must list anybody that lives with them, or else if someone is caught driving and lives with them and were not listed, then coverage is no good.  It is sort of like having a blanket "excluded driver" endorsement.  

You question to the adjuster should be "Is this an excluded driver, or just a question about permissive use?".

If it is neither, then you can bet there is the "unlisted household member" endorsement at play and you better hope the person driving the other vehicle, didn't live with the owner's of the vehicle at the time of the accident or else you will have no insurance other than your own to rely upon, and only if you carried the proper coverages.
