Auto Insurance Claims: Recent Car Repairs, preferred shops, place insurance

Hey, I was in an accident on March 11th. The lady I hit had caused her own accident (which she got a ticket for) then I had no time to get over. Long story short I did everything in my power to try to stop my Dodge Durango! I cleared all tread on 4 tires, took paint off road.. and still couldn't do anything. My insurance ofcourse took the blame because in VA if you hit someone (rear-ending) its your fault no questions.

The insurance decided they were going to fix it, they told us a list of places that we could choose from. We choose a Chevy shop. They gave us a list of things they were going to fix. Two weeks went by me and my mother went to go get it. I drove it home realized it needed an alignment very badly, and something was wrong with the brakes. We called the shop they said that we had to take it to the place that put the brakes on to get them adjusted. My step-father works at a car shop that does all the work for my car. We got there and they tell me "You cannot drive this car off our lot you have NO brakes". I'm 19 years old, I told the people at my insurance that I had my foot on the break as hard as possible but they never even looked at the tires nor the brakes according the the man at the Chevy place.

Insurance adjuster went to go look at the durango said that the hub to the front tire was bent and they will not be fixing it?? Don't they have to fix it if they have already started, considering there was nothing at all wrong with the durango until the accident? Or do we have to go about this by trying to sue because if someone would have pulled out in front of me i would not at all been able to stop, they put my life at risk.

First of all, you could have taken your Durango to any body shop you wanted. Evidently, you were "steered" to one of their preferred shops, one that discounts the work for your insurance company.

As for the brake problem, there is no excuse for them to return the truck to you with the brakes not working properly. Any damage done to the truck that were the result of the accident should have been repaired.

You should call your insurance agent or the adjuster in the claim and complain that the shop gave you the truck back with no brakes. As for the adjuster saying they would not be repairing the damage to the brakes, have him put that statement in writing. Then contact your state insurance department and file a complaint against your insurance company and tell them the story. Send a letter to the shop and tell them that you will be taking legal action against them for their negligence in their overlooking the brake problems and returning your vehicle to you in an unsafe condition.
