Auto Insurance Claims: Auto Collision, reservation of rights

ON 3-09-10 A driver backed into me while i was stationary. I honked my horn for about five seconds before it happened. I got his insurance info. Plate number. Witnesses and called the local sheriff's dept. I have filed a claim against him with his insurance company. When i call the insurance company and ask why we haven't seen an adjuster yet, they tell me that until they get in contact with the other party, they cannot establish liability/responsibility. This has gone on long enough and can no longer be without a vehicle. I have gotten estimates for the damages. What would be some of the steps i could take to make this move along faster. Thank you in advance for your help and guidance.

  Ask the other insurance company if they are asserting a reservation of rights, and ask them for the letter in writing.  They can indeed refuse to pay your claim if their customer will not contact them.  Your only option is to locate the other driver and put some pressure on them.  As a former recovery specialist and owner of a company that contracts out recovery work on insurance claims, I can tell you the only way you can speed this up is to either convince the other carrier to go ahead and pay without actually speaking to their customer (unlikely), or get their customer on the phone and three way a call to the adjuster so they have no excuses.
