Auto Insurance Claims: Hit twice and only half the med and the rear end is offered, adjustor, rear portion

Question
On Feb 13th I was on a 5 lane road coming to a stop due to a stop light and traffic in front of me. I managed to reach a speed of maybe 5 mph when I was struck by a car, that I believe may have been doing the speed limit of 40-45+ mph, in the rear end. It forced me into the vehicle in front of me and then was struck a 2nd time, yet again forcing me into the vehicle in front. We all pulled of the road and I called the local police. We all filled out a report and the person responsible was given 2 ticket, at the same time admitting fault. Then went home and called my insurance agent to file a claim. The next day I go to the hospital with neck pain, back pain and leg pain. The doctor gave me some meds and sent me home. I contacted State Farm to file a claim and gave my story to them. About this time I started getting light headed and headaches. I contacted a lawyer (the kind that they get paid if you do)and their claims rep came out and I signed the paper work. I started seeing a chiropractor two days later that took some x-rays and only saw that there might be only a little tight spot in my lower neck but nothing that would cause the pain I am experiencing. The adjustor came out and looked at my vehicle and left. A few days later my friend that was in the accident received a phone call stateing they would only pay half of his medical bills. He refused and stated to them that they owed his bills in full and hung up. A week later I received a check from State Farm for the damage to only the rear portion of my vehicle.

I called the person that approved the check and signed it. She insisted repeatedly that they are approving the rear end damage and declining the front. She claims that the damage that was apparent to the rear end of the vehicle was theirs however the damage to the front could not have been caused by the accident by the evidence that was submitted to them. The evidence being in part extremely minimum damage done to the vehicle to my rear and to my front. The rear had a bent slight bent fender and a busted headlight and the one to the front only suffered a small scratch on its rear bumper. I however suffered the back bumper and hatch being messed up and on the front end the hood folded in half and the front and sides lifted up about a inch.(Front end meaning the entire grill, bumper and both fenders) I told her that even the police report states that she admitted to hitting me. The State Farm lady said they do not use police reports to make their decision. The driver did not admit to hitting me twice but both me and my friend and the older couple in front of us said that she had but she did admit to hitting me while attempting to change lanes. In the mist of it all state farm stated that she was currently awaiting a letter from my lawyer saying that they no longer represented me. I kept insisting that they pay for the damage to the front of my vehicle and that I was, for the 2nd time, becoming a victim of this crash. She also stated she was sending a letter stating the claim was now closed. She refused all the way to the end when the phone system shut down promptly at 4:30. I then called my lawyer, just to reassure myself, to find out that they were indeed no longer representing me due to that it would not "be a positive gain". I still continue to see the chiropractor however, the insurance company still refuses to pay for the front damage and the other half of the medical costs. (Still Building)

What should I do and what needs to be done? I did what I thought was a correct course of action and it blew up in my face. I haven't cashed the check or signed anything with the insurance company either. I am in Arkansas and I have no idea if I just ran into a bad situation that I have to end up being a victim or if this was some kind of con or scam. If I did, is there a way that I can sue either the insurance company, driver or both. If it isn't then what is the correct course of action that I can just receive the costs for my front end and all my medical bills? I hope all of this makes some since, I am still heavily medicated.
At no time at the accident before or during the accident was I on drugs, drinking or anything else, in case I looked over something like that. The driver that hit me also did have her premiums paid up to date.

Please help,
In pain and really confused

Answer
Dylan,

It's not scam or a con - it's just State Farm doing what they do best - making it almost impossible for the average person to get what they are entitled to.

You're kind of stuck in a bad situation.  My guess is that your lawyer realized they're are not enough injuries to make a lawsuit feasible against State Farm - so it's not a "scam" but the unfortunate results of State Farm's bad faith business tactics.

You could try and sue the other driver in small claims court yourself.  That's about the only way recourse you have.  It's a pretty easy process but it's still a hassle.  Sorry to hear bout another case of State Farm sticking it to the little guy.

Best of luck,
