Auto Insurance Claims: Title/Lien Holder Payment, lienholder dispute

Question
Does the title/lien holder of my car(I'm making payments) have the right to request an additional deductible from me even if my auto insurance has already subtracted my deductible from the claim check. My Lien holder's name is also on the check and wants to do the body work themselves, which I don't want. They want me to either bring my car to their body shop, which I'm sure they will cut corners and pocket the difference, or, they want me to get the work done first, then have my body shop bring my car to them so THEY can inspect the work and THEN issue payment to my body shop after. At which time I'm sure they will try to pocket the difference. What should I do?

Answer
Juanita,

I cannot answer your question without seeing your contract with your lienholder.  With that being said, I will say that what you are describing is HIGHLY unusual.  Vehicle owners generally have the right to pick where their vehicle is repaired, and the only thing that could impede that right is a written contract.

I would definitely request that the lienholder provide me with some documentation that demonstrates their right to dictate repair.  If they refuse, I suggest contacting a professional and reviewing your options.  If they are attempting to mislead you, they are very brave as there are harsh consequences for violating the Federal Unfair Trade Practices Act.
