Auto Insurance Claims: passenger in auto accident, own insurance, fault coverage

My question is pretty basic. In NJ if you are a passenger in a car accident and are injured does the claim go to your insurance to process, not the driver pf the vehicle. If you could answer asap, I'd greatly appreciate it.

That is not such a basic question, lol.  In NJ, when one purchases insurance, they are presented with a choice.  Your policy terms dictate whether you have to go through your own insurance, or whether you are to pursue your damages from the negligent party.  

Unfortunately, without seeing your personal policy, I will be unable to answer your question.

Generally, if you are a passenger and the driver was negligent, it is proper to file for coverage through the driver's policy.  If you have elected to be governed by the limited no fault coverage on your own policy, then you may be required to file with your own insurance.
