Auto Insurance Claims: Other driver didnt provide info in fender bender, minor fender bender, insurance company

Hello,

Today, my boyfriend and I were in a minor fender bender at a gas station.  We live in California.  After seeing the pump was out of order, my boyfriend began slowly backing up to the pump behind us - he checked his mirror and was looking behind him while backing up when suddenly a car hit us.  Our damage is on the back right side, above the tire and the other driver's damage is on their front left bumper.  The other driver just kept asking us to sign something that said we were at fault for the accident.  We didn't sign, of course, and provided our information to him and he got in his car and drove off without giving us any of his information.  We immediately contacted our insurance company and notified them of the situation.

There were no witnesses besides the passenger in the other driver's car and me and the police were not contacted.  Since my boyfriend was backing up, will he automatically be at fault if the other driver files a claim?  And do we have to file with the DMV even though we're not sure how much damage was actually done to the other car?  We aren't filing a claim for the damage on our car - it's a scrape and our car is old anyway.  Our insurance covers the other driver but we opted out of insurance covering our vehicle.

Any advice would be appreciated.  Thank you for your help!

Hi Sarah,

At this point you have done eveythng you can. You will likely be considered to be at fault. But you will just have to wait to see if the other driver files a claim against yur insurance. If they do, your insurance company will investigate, inspect the car and only pay what is owed.
There is nothing else you need to do at this point.
