Auto Insurance Claims: collision, tow company, time elapsed since

Question
I was stopped in a turn lane and a tow truck turning right was trying to make the light and the tractor that he was towing continued to swing into my lane and impacted the driver side of my car causing almost $4000 dollars in damage.  They admitted fault to me.  they said they would take care of the damage.  In oregon I have 72 hours to report the accident but they say they want to take care of the accident themselves but wanted me to provide 3 etimates, the value of the car, what I paid for it, and a copy of the title which I provided.  I am at the limit of the 72 hours.  what will happen if I file late? and will they still be liable for the damage?

Answer
I am unsure of the law in your state and any possible repercussions from the late filing. However, go ahead and make the police report regardless of the time elapsed since the date of loss. It may be needed later in case the tow company gets difficult to deal with. If you have witnesses or photos to support your version of the events, that may support your case, irrespective of the report to the state.
