Auto Insurance Claims: Rear ended, poor visibility, car wreck

I was involved in a car wreck. I hit a guy that was stopped on the highway he was going turn left on a street. Its just two lanes , it was 7:30 A.M. it was dark and rainy. This guy did not have his taillights on so i did not see him until i hit him my car is totaled there were two witnesses that said the same thing. They had no idea there was a truck there. Should his insurance agency pay for my car?

If you can prove with statement from your witnesses that it was dark, there was poor visibility, and that he did not have his lights on when you hit him, go for it. Make sure the witnesses are not related to you or could have their statements dismissed for any reason. Also get the police report if available to see what their position on the events was.
