Auto Insurance Claims: No Insuance, involved in accident, not at fault., No Insuance, involved in accident

Hi,

I was involved in an accident. I was on my way out for lunch, as I was exiting the parking lot in front of my job, when a lady reversing out of a parking space hit the middle, back end passenger side of my car. I have no insurance. I was laid off and just started working and was in the process of choosing another insurance company; this is why I have no insurance. I have a car that has a loan on it as well.

My question is, how will this work out? Am I automatically at fault because I have no insurance at the time of the accident, even thou it was not my fault? What are the penalties for this? Is there anything I can do to help myself? My car has a lot of damage and her suv has a couple scratches.

Well, a fault investigation must be done. This is where things can get ugly for you. The "usual" or "normal" process would make both insurance companies do that investigation and come to an agreement (or arbitration). Since you have no insurance, you will have to defend your self, and the other side will probably take a harder stand.

Parking lot accident are not always clear, and in fact, more often than not, they will place fault on both drivers. To learn more about fault, please see:

What is the effect of no insurance? Well, it depends on your state. For example, if you do not carry insurance on your vehicle in California, your claim is barred. Other states have different takes on this.
