Auto Insurance Claims: Should the claimant concede?, juris doctor, claimant

Question
Although you have answered my three questions, I still do not know what is the claimant option if the adjuster sticks to her offer without change or a little change. So I am going to ask you the question in different way. We know the negotiation is to let the adjuster increase the offer. Should the claimant also need to concede during the negotiation or getting the demand amount is the only purpose for the claimant to negotiate; otherwise taking legal action will be the next choice if the insurance does not want to pay the demand amount? Thanks for your answer.

Answer
Hello again, Zilch,

I think that you give a little and she gives a little and then she says "no mas".  If you are at that point, then you need to make a decision whether or not you wish to file a lawsuit.

If you do not think that giving her any further information will make a difference to her, then consider what it will be like if you sue.

The four factors to consider when you sue are the court & doctor costs, the personal time & hassle, the delay in getting this resolved, and the bite of attorney's fees.

As for the latter, consider trying to negotiate a discount on account of the offer you have in hand.  http://www.settlementcentral.com/page0109.htm
