Auto Insurance Claims: Parking lot collision, claims adjusters, car door

I was pulling into a parking space earlier today and as I did the driver next to me opened his car door into my rear passenger door on the right side. His car was left undamaged. I feel that in this situation it is difficult to decide who assumes liability. I am inclined to think that it would be his fault, considering that it was my back door that was hit. He claims that his door was already being opened, so he believes it was my fault. Is there a standard procedure for this situation?

Hi Mardi,

There is no standard procedure in this instance. The claims adjusters will take recorded statements from both of you. Based on who they feel is being the most complete and the most honest they will nake a liability decision. The most likely liability decision will be 50/50.
