Auto Insurance Claims: Liability coverage, liability limits, car title

Question
I live with my mom. I drive her car. i am on the policy as an additional driver. The car title is in HER name and registered in HER name. if i get into an accident that is my fault and I hurt or kill someone, can they sue my mom above and beyond the coverage of the insurance policy?

Answer
Hi Riccahet,

In most cases no. If you are 18 or over and the accident is your fault, then the liability would rest solely with you. However, a slick lawyer may find a way to try to make your mother liable since it is her car.

The best thing to do is to have your mother contact her insurance company to see how much more it would cost to increase the liability limits on the policy. It usually does not cost much more to increase the policy limits. She should have at least 100/300/50 in liability limits.

I hope this helps
