Auto Insurance Claims: totaled, total loss auto

Someone crash my car,his insurance says its totaled damage,they want to give me tha value of my car on the market but i still own on the car. Value they want to paid is 17,907. but i still own 25,980.I didnt crash this person crash me now i have no car and keep paying for a car that i dont even have,,,sorry but doesnt make no sense,,what can i do??

Whether you collect from the insurer or the driver of the other car, the most they owe is the "market value" of your car, not your loan balance. So if you got a 6 year loan on your car so you could have low monthly payments, you probably owe a lot more than its worth. You should not finance a car for over 3 or 4 years.
