Hoping for information on this my family was t-boned while crossing an intersection the driver was not on the insurance policy. At first the company assumed responsibility, but upon learning that my 4 year olds medical bills were in excess of 30k with future reconstruction surgeries needed and husband's injuries will probably average the same numbers.  Now they have backtracked and said that the policy excluded any other drivers besides the insured and will not cooperate.  Did they not assume responsibility when they took my totaled vehicle from the wrecker yard.  It has been over 1 month and I have not received any compensation for my vehicle or damaged property. Is this just a tactic to avoid paying.

Yes, this is a tactic to avoid paying. The insurance company does not want to cover this claim (there is too much money on the line) so they will try to decline payment. You need to contact a lawyer on this one, at least to see if there is coverage. There might be coverage under your own insurance policy, depending on what your policy says and what coverages you have.
