Question
My son-in-law was plowed into from behind while sitting at a red light, he struck the vehicle in front as well. What is the obligation of the at-fault drivers insurance for him. His truck is less that 7 months old with low mileage. Now, with a severely bent frame and a negative car-fax history, his investment in this new vehicle has disappeared.  What MUST this insurance company do to make everything right?  We are in Virginia. BTW, there was bodily injury as well.

Hello Bryce,

The insurance company MUST only pay your son for the fair market value of the car. This can be problematic if what he has invested does not ad value in real market conditions. In other words, the insurance company will pay for the vehicle, but will not pay for any additions or upgrades (at least not dollar per dollar) and this causes a lot of problems.
