If I wrecked in Kentucky and was injured and the insurance company is in west Virginia, and the insurance company is paying for my medical bills and it has been a little over a year is it to late to get a settlement?

Hi Melissa,

No it is not too late. In most states the statute of limitations is at least 2 years. In many states it is longer than that.

Before you attempt to reach a settlement, you need to determine the value of your claim and assemble all of your bills and treatment dates into what is called a "Demand Package". This is where you outline all of your injuries based on the diagnosis of your medical providers along with all treatment required, the dates of treatment and the costs of treatment. Then you make a demand of an amount of money that you want to settle the claim.

There is a website called www.collisionwizard.com that will help you put all this together. The website is produced by the Better Business Bureau Video Series and best of all it only costs $19.99. It has a claim calculator that will tell you an appropriate value range of your claim based on the information that you enter. The program will also help you create your demand package.

If at any time you do not feel the insurance company is treating you fairly, you need to speak with a personal injury attorney.
