Auto Insurance Claims: Hit & Run, stolen vehicle, car one

Question
Hi, my boyfriend recently got into an accident with my car. He was hit by a car that was reported stolen. The driver fled the scene and the owner was called. My insurance won't cover it because my boyfriend does not have a license. So they told me to go to vehicle 2 insurance and they told me they wont cover it because it was not their customers fault that hes car got stolen. What can I do from here? The cost to fix the damage is 6,000 and I am still paying monthly for my car. One more thing, I really dont want to sue but just some financial help getting my car fixed but I was told I could sue for negligence. The owner of the stolen vehicle left his car running. What do you say?

Answer
Hi Jezebel,

Don't waste your time fileing a law suit. The person who owned the car that hit your car is not liable since his car was stolen. His insurance will only pay if he was legally liable to pay you for the damage and he is not since it was stolen.

The only thing you can do is to try to get your insurance company to pay. If you did not know he did not have a license or something like that.

Unfortunately, there is not much else you can do. You may end up paying for the repairs yourself. You may also want to consider not letting your boyfriend drive your car until he gets a license and proves it to you.

I hope this helps
