Auto Insurance Claims: pedestrian car, pedestrian car, damages

Question
was hit by a vehicle in Dec. 2009. I was transported by ambulance to ER (this was Christmas season btw) and given an arm sling and pain meds. I have been under treatment until recently (can't miss too much work) including chiro and PT. I have a rotator cuff injury that still causes me pain and I have limitations because of the injury. My med bills are about 6K. I had to pay someone for household help for Holidays and missed two weeks of work in Dec. The insurance co wants me to forward info to them for settlement. I believe pains and suffering is extra because they jacked up my Christmas and New Years and I am still having shoulder issues...  I have some expenses for household help over the holidays.  We are pretty strapped financially right now and would like a fair settlement.

Answer
Hello renaye,

You have a stronger case because you have a pedestrian v. car accident (juries feel bad for pedestrians). However, there are too many variables that will add/subtract to your claim (age, pre existing injury, wage loss, your state, etc.). It is very difficult to give you a straight number without any of these number.

The best person to help you really will be a personal injury lawyer (most of them will give you a first consultation free), you can ask them what they believe your claim will be worth, and they can guide you.

In the mean time, you can see what kind of damages you are entitled (and how to evaluate them) at: http://www.auto-insurance-claim-advice.com/bodily-injury-claim.html

I hope this points you in the right direction

Good Luck
