I live in North Carolina.I was sitting at a stop light.when the light turned green the car behind me decided to go before I did and rear ended me.the officer on the scene said since the damage was less than $1,000.00,I'd have to turn it in my MY insurance and let them pay.He hit me.His insurance should pay.

You are correct.  File a claim with his insurer.  If they do not pay promptly, you will need to use your insurer and let them subrogate against his insurer.  This is the process where they collect reimbursement for any payment they make as well as your deductible.
