Auto Insurance Claims: liability?, accident occured, insurance info

Question
Richard,
I was in a parking lot, approaching a left hand turn.  I saw a vehicle coming (very fast) from the direction I wanted to turn, so I stopped to let him pass.  The oncoming driver swerved to miss me and hit a parked car.  There was no police report filed, and the officer advised that this accident would most likely be "part forms".

My vehicle was not touched.  There were absolutely no injures.  The other driver, who hit the parked car, has his insurance harassing me for my insurance information.

1.  What does "part forms" mean?
2.  What can I do to get their ins. co. to stop calling me?

Answer
Hi Steve,

In 22 years in the insurance industry I have never heard the term "part forms". What he likely meant is that you would be considered partially responsible for the accident. The other drivers insurance company is likely trying to contact you to take your statement as to what happened in the accident. You should call them to give your statement. You should be very clear that you had stopped to let him pass and that there was no contact with your car. You should also state that the only reason that the accident occured is because the other driver over corrected causing the accident. If they want your insurance info you should give it to them. Then you should immediately call your insurance comapny to report the incident and give your insurance company the same statement. They will then handle it from there.

I hope this helps
