Auto Insurance Claims: Hurt is car crash, Hurt is car crash, car accident

Hello Anne,

I was hit by a red light runner. My car was totaled and I was injured in the crash.  The police cited the other driver for running the red light and the driver also admitted guilt.  

In conversations with the other parties insurance company they have assured me that all of my medical bills will be paid.  However the doctors that I have seen do not want to be involved in an auto injury case and have taken a “stand offish” position.  

My doctors have not given me a strait answer.  I have seen my primary care physician, neurologist, neurosurgeon and chiropractor.  I will start physical therapy in the next few weeks.  I have also had numerous tests done.  I do have bruising on my c-spine.  I will have to have another MRI as this bruising could have been there previous to my accident…..  The numbness in my hands, feet and face have not gone away, it has been 3 months almost with little relief from any symptoms.

I know my medical bills are going to be astronomical- I am worried that they are not going to be paid or a loop hole will be found to deny my claim.  I do not have an attorney and do not want to get one.  I’m not sure what I should do.

In a situation like this what are the logical steps to make sure medical bills are paid by the other persons car insurance company?

Well, You should consult with an attorney. I know that you do not want to, but this is the only way to really protect all your rights. Usually the first consultation is free and they can answer a lot of questions for you.

At any rate. I am not sure what you mean the doctor is not giving you an straight answer. Are they going to bill the insurance company or not (some doctors do not take auto insurance company payments).

Remember the insurance company of the person that hit you will only pay for medical expenses once you settle (could be two years down the road, depending on the statute of limitation of your state). In the mean time, you will have to have your own auto insurance pay for this expenses under the PIP or Medical Payment coverage of your policy. This usually is limited at a certain amount (5k or 10k or something like that). If your bills are above your limit, you will have to pay out of pocket until settlement unless you work something out with the providers.

This is why you need to talk to a lawyer. They can help you identify what kind of approach to take. It also depends on how bad is your injury and how many findings there are to show that the bruise is "pre existing" or due to a new injury.
