Auto Insurance Claims: Motorcycle accident,, bone contusion, better business bureau

Question
Hi i was in a motorcycle accident a few weeks ago the other driver was at fault and his insurance company accepted liability, i have a torn labrum, bone contusion, and bursitis in my shoulder, i am going to see a orthopedic doctor to discuss wether or not i need surgery and i will definitely need physical therapy, i was hoping to not get a lawyer but want to make sure i get what i deserve i know it is still early but what is the range of a settlement i should be looking at, maybe if i need surgery and if i don't, i was also wondering my options of how to get the medical bill paid, i read it is not a good idea to sign the release, is my only option to get billed myself and forward the bills on? or can the hospital send the bills with out me signing the forms? thank you

Answer
Hi Jason,

You will be responsible for all of your medical bills as they are incured. The at-fault drivers insurance company will not pay your medical bills as they are incurred. They will only do a one time lump sum settlement with you once all of your treatment and therapy is completed.

If you have medical insurance, you would put the bill on that. Then when you reach a settlement, you will have to reimburse your medical insurance for the costs they paid.

The process of reaching a settlement could take many months or longer depending of the extent of your injuries and treatment and if you require surgery or not. The value of your claim will be determined based on a combination of factors including the seriousness of your injuries, the length and cost of your treatment, number of visits to therapy and whether or not there is any permanent limitations, scaring or disability. Generally, you should seek 3 to 10 times the total cost of your medical bills plus any lost wages.

You should visit www.collisionwizard.com which is a website developed by the Better Business Bureau Video Series. It will help you calculate the value of your claim as well as organize all of your bills, treatments, etc. It will also help you develope a demand package when you are ready to make a settlement demand.

I hope this helps
