Auto Insurance Claims: No progress with Insurance Adjustor, insurance expert, claim settlement

So long story short i was car jacked my car was recovered but it had been involved in a collision a police report was obviously taken that same week i made the claim an investigation is made nothing pops up.Adjustor steps in does whatever it is they do 2 1/2 weeks pass by adjustor calls saying car is a total loss a settlement payment will be introduced as soon as the affidavit is completed and sent back.since the car was financed the company agreed to wait for the settlement check since i said i wouldn't pay all the fee's they were charging for the towing fee's & all that which they wanted up front i couldn't pay that large amount so i explained that as soon as the insurance was finished i would pay them the settlement & than go with the GAP insurance i had to payoff the rest & break even
One month goes by no word from insurance adjustor after i had sent the affidavit back we/thier return envelope i called & left countless messages but response until about over a week after i called only for the adjustor to tell me she never received it so again i have to wait for the new one only this time i get it certified the day i sent it arrives the next day because i checked the tracking # only to get a response over a week later that the witness signature wasn't valid so she had sent it back to fill it out we/ my insurance brokers signature immediately i responded Via e-mail for to just fax me the documents so could print them out have it filled out swiftly & Appropriately & back to her in no less than 2 days because time is a factor here i have not heard from my finance company so i don't where i stand with them since they have the vehicle nor have i had a response from the adjustor who just keeps on making this longer than it should be take this happened 8/5/12 & todays date is 10/24/12 over 2 months with no progress & i feel like she lied about ever receiving the 1st one & the time it take for to respond to me need some advice here please??

Simply stated - you're getting the run-around. And,it is unacceptable.

OK, I understand that your car is an "auto theft".  In these claims insurance companies virtually always require an affidavit of theft.  That's because they want you to sign what becomes a sworn document that the facts of the theft, as you allege them, are true.

But on the scale of crimes, a carjacking is certainly a greater crime than an auto theft.  And, clearly the crime was reported to and documented by the police.  So is an "affidavit of theft" really necessary?  I suppose only if there is genuine evidence that strongly suggests that you "had something to do with it" and that in so-doing, you stood a chance of "profiting".

Yes, all of this seems preposterous.  And, in my opinion, so is the affidavit of theft under these circumstances.

While the adjuster is not technically violating the rules,she is being completely, totally, unforgivably unreasonable.  It is bad enough that you are being subjected to what I believe is an unnecessary process in this situation, but now you are being exposed to incompetence as well.

I suggest you call the main number of the insurance company with your claim number and ask for the name of the claims manager responsible for this claim.  Speak to the manager to voice your concerns.  Express specifically how this entire process is causing an even greater loss than what you have already suffered.  Stress also that you have complied with all requests, that you have cooperated fully, and that delays have not been caused by you.

Before you call, write down a timeline of events so that you can be very specific with your complaints.

The manager should be able to resolve your problems immediately, like within the day you call.  If you hear nothing, call him back.  I would also suggest that you follow up in writing if there is not an immediate response.

If none of this works within a matter of a few days, contact your state Dept of Insurance to inquire if they have a consumer complaint system available. If they do, file the complaint, and advise the claims manager that you have done this.

If all else fails, you should consider hiring an attorney to prepare a strong letter to the claims manager.
