Auto Insurance Claims: AUTOMOBILE ACCIDENT WITH INJURIES, spilled coffee, automobile accident

QUESTION: HI
I WAS INVOLVED IN A CAR ACCIDENT IN SPRING 2006
WAS STRUCK IN SIDE  BY ONCOMING CAR DOING 60MPH
MULTIPLE ROLLOVER. DIAGNOSED WITH PERMINENT INJURY TO NECK C5 C6 PROTRUSION WITH CONTINUED MUSCLE SPASMS.
2 1/2 YEARS OF PHYSIO, MASSAGE, ETC ALL THE FOLLOWING.
WAS FINALLY DEPOSED 2 1/2 YEARS LATER.
WHAT A WASTE OF TIME FOR THE DEFENSE. CLEAR CUT CASE IN MY VIEW,  AND MY ATTORNEYS  THE INSURANCE COMPANY OFFERED ME 75,000 TO GO AWAY (PRE DEPOSITION)
THE MEDS BILL TOTALED 50,000 AND COUNTING
WHAT HAPPENS NEXT AFTER THIS INNING?

ANSWER: Hi Tim,

It sounds like you have been through enough without spilling hot coffee on yourself.

This is actually a question that you should be asking your attorney. However, it does sound like the insurance company was low-balling you. I would think that your situation would be worth $150,000. to $200,000.00 including medical bills, pain & suffering, etc. Of course your attorney will get 33 to 40% of the settlement amount. If your deposition went well, I would suspect that the insurance company will be contacting your attorney with another offer to try to get this settled before any trial. Your attorney will then contact you to discuss the offer. There may be several more back & forth rounds of offers and counter offers. Eventually the claim will be settled or you will go to trial and hope for the best.

Hi Tim,

There is no way to tell. The larger the claim, the longer it could take.

You really need to request a meeting with your attorney. Ask him or her what is going on? Any new offers? Is there a trial date set? What is the insurance company attorney saying to try to minimize the claim? When do you think this will be resolved?  How much do you think would be a good settlement?

You need to ask all of these questions so you will know what is going on with your case. I can not second guess your attorney.
