Auto Insurance Claims: insurance problem, insurance problem, insurance issue

Hello! And thanyou so much for taking the time to respond to my message, all help is truly appreciated!!

I am actually writing this on behalf of my fiance, I just want to see if I can get some good, reliable information to perhaps lead him in the right direction with his situation.

Last month, my fiance was involved in a minor car accident, a fender bender I would say. UNFORTUNATELY, because he hit the woman from behind, he was automatically at fault. He is a very good driver, and is adamant that the lady merged off of a ramp (this accident was on the highway) and she pulled out in front of him and applied her breaks hard and stopped suddenly.

Regardless, what happened that was the worst, is that he called his auto insurance company immediately (this was at 6 in the morning, for he attends a technical institute) and proceeded to make the claim for the accident. Whereupon he was informed that morning, that his new car, was NOT covered by any insurance. He spent half the morning calling different people in the company but in the end, the fact was that he did not have insurance for his new car.

His car is now almost 3 or 4 months old, and when the accident happened, it was almost 2 months since he bought it. He called his insurance company to switch the coverage from his old car to his new one, and apparently, the switch did not happen. Of course, the morning of the accident, he immediately had his car insured as soon as he was made aware of this discovery.

However, his problem now, is that the woman who he hit, seems to want to take legal action, and his insurance is saying that will not cover the damages because the insurance was not their prior to the accident.

Also, he was given a fine by the officer who came to the scene, for driving uninsured, and because he is almost finishing school for mechanics, he is worried that points will be put on his license and it will look back on his record when he finally goes to inquire about a job.

He is trying to fight this, but he is stressing himself quite alot, and I dont want him to lose concentration in his schooling, for it is very important.

our fiancé needs a lawyer. There is really nothing else he can do. The insurance company will have to do an investigation and find out when and who he talked to when the car was purchased. He will need to get his other policy (the one from his old car) and read it carefully. Some policies give automatic coverage for new vehicles for 30 days after the purchase.

You do need to get a lawyer. It is very important to you have legal advice. The insurance company might simply want to deny your claim so they do not have to pay.

If he can show coverage, then he might be able to get the ticket of his license. Other than that, there is not much he can do.
