Auto Insurance Claims: claim, state insurance commissioners, factory warranty

I purchased a new truck for my son when he graduated -a 4000 miles he had trouble with the transmission and subsequently it drove itself into a pond after retrieving truck towed to dealer for repair dealer claims water damaged done and voided the factory warranty --suggested I call my insurance--adjuster came out and called me said the truck is a total loss this is in September 2008 agent called me advised me to collect my belongings that the truck was picked up and it was removed from the dealer now 6 months later I get a letter stating my insurance is not to be renewed and that they are sending me back the truck go luck--is there anything I can do

There ar too many unanswered questions here. For example:

1) If the truck was totaled 6 months ago, why has the insurance company not paid you?

2) If they are now saying that they are returning the truck to you, have they provided you in writing the specific reasons why?

3) Have they specifically denied your claim?

4) why are they non-renewing your policy?

There are many other questions that would depend on the answers to the above questions.

Usually when this type of situation happens it is because the insurance companies investigation of the claim has resulted in them determining that you had something to do with the vehicle going into the pond. Which means that they think that this is a fraudulent claim. If you feel that their claim denial is improper, you should file a complaint with your state insurance commissioners office.
