Auto Insurance Claims: auto accident settlement, kelly blue book, vehicle depreciation

I was in an auto accident the end of February this year. The man rear ended my vehicle as I was stopped for traffic. His insurance company after all these months finally are trying to settle. My question is what amount do I settle for or is fair? My medical bills currently total $6300.00 and what about the depreciation of my vehicle amount? I sustained neck, shoulder and lower back pain from this accident, I still have the pain. Any help in this matter would be greatly appreciated.

I need some additional information to answer your question:
-what type of damage was done to each vehicle?
-please list the types and amounts for each medical provider, as well as the number of visits.
-what was your diagnosis?

Also, if you are still having pain, you should consider whether or not this is the time to settle.  Has your doctor released you from care?  Are you expecting further care?  Once you settle, your claim is over and you can't go back for more.

The vehicle depreciation is known as a "dimunition of value" claim.  This is separate from the injury claim.  Laws vary by state on how this is valued.  In most states, you can make a claim for the difference between what you can now sell your car for compared to prior to the accident.  This is a subjective amount and not easy to determine.  You can get an idea by playing with NADA or Edmunds or Kelly Blue Book online for values.
