Auto Insurance Claims: intersection side impact collision, snowy road, tag number


Question
Today it is snowing heavily; the roads are covered with about 3-5 inches of snow.  On a small side street my husband's truck was hit in the rear box by a car, 2/3 of his the way through the intersection (no one was injured). The police were called, the truck towed away, totaled. Then about an hour later the officer showed up at our house with a citation for Failure to Yield; the officer said, because, the other driver insisted my husband did not yield. My husband insists that he did yield, looked right then left and he did not see anything coming (he was not going any faster than 10-15 mph on the snowy road). The officer says my husband told him, himself, at the scene that he did not slow down at the yield. My husband says he has no recollection of this question being asked of him. This citation makes my husband the cause of the accident which, my husband is sure is not his fault. We don't even have an accident report, the woman's name, tag number or her insurance. We feel like the officer decided it was my husbands fault; end of story. There were no witnesses except the woman's 3 young children. We phoned our Insurance company but, does this citation mean that her insurance company will deny our claim?  We don't know what to do.

Hi Sharon,

Unfortunately, based on your story it sounds to me that your husband would be at fault. Anytime you cross an intersection where the other traffic has the right of way and you are hit in the side, the accident will be considered to be your fault.
