Auto Insurance Claims: insured auto/uninsured daughter, nussbaum, own car


Question
I reside in TX. My daughter is 20, attends college full time and has an appartment in OK where she lives and worked full time. Her drivers liscense does state my home address even though she has her own place in OK. All of her mail and bills in her name go to her address in OK. She has lived in OK for three years and currently has a year lease. She does not own her own car nor is she insured. I gave her permission to drive my car when she arrived for a visit for Thanksgiving. She had a fender bender. Will I still be covered for this accident?

The laws of each state are different. In Florida, where I practice,  you would be covered. My understanding is your daughter came to visit, but does not reside with you, and borrowed your car and got in an accident. If she had her own vehicle with coverage, she would go through her insurance to fix your vehicle but since this is not the case, you would be covered. You may want to check with a local attorney if your insurance company denies the claim. I am assuming the "fender bender" was her fault?  If not, it would likely be covered by the insurance company of the at fault person.
