Auto Insurance Claims: no fault accident, insurance company, policeman

My daughter was ran over by another driver on a 2-lane one way street.  She was orginally cited, but after a thorough review by the police her citation was dropped and the other driver was found at fault.  The policeman handling the accident failed to get names of witnesses that assisted my daughter after the accident.  My insurance has totalled her car and I am waiting to hear from the other insurance company.  I have been told since it is a "he said, she said" type of situation that the other insurance can refuse to pay for her car. What should I do?

Hi Angela,

In this type of situation you should let your insurance comapny handle the claim. They will then fight it out with the other insurance company to try to obtain reimbursement. This way your claim is handled faster, you only stand to lose your deductible and you can go purchase a replacement vehicle with the claim proceeds.
