i was in accident two week ago and it was not my fault other driver cut me off he was get on the interstate 15 in springville Utah 84664-3 i was going over the interstate other drivers insurance is not pay out the right payoff the loan or not paying the value it is. what is my legal rights for it not being my fault and the buyback the vehicle?

The insurance company is responsible for paying the actual cash value of your car. The amount you owe on the loan is not relevant.

If you feel they are not paying the actual cash value of your car, then it is up to you to prove them wrong. You should request a copy of whatever was used to determine the value of your car. That way you can check to see that they have the mileage and options correct. Next you can go to www.autotrader.com to look for other cars like yours currently for sale in your area. Print out the info you find and if the values are higher you should send that info to the insurance company to try to negotiate a higher value. If that does not work you can hire and independent appraiser to determine the value of your car.
