Auto Insurance Claims: Backing out of parking spot accident, parking lot accidents, policy numbers

Hello. I was backing out of a straight in/out parking space today when another driver and I collided. There were two rows of parking with about a 10 foot space in between. I had looked to my left which was clear and then looked to the right which was also clear. I started to back out still looking to the right. I was over halfway out of the stall when I looked back to the left just in time to see another driver directly behind me and a split second later I felt the impact. She just kept going and in turn left a long scratch on my car and some damage on her drivers side rear panel. She kept demanding it was my fault. I spoke to my insurance company and they said we did not need a police report and to exchange information, which was done. I do not believe this was all my fault. I cannot see both right and left while backing out and I was far enough out that she should have seen me and should have honked her horn to alert me of her presence or stopped. I have no problem paying for my own damage, but I do not think I should be responsible for her damage. What is your opinion? Also, the other driver is covered under a Binder insurance policy. She had no policy numbers or phone numbers for this policy. Thanks for any information you can provide. We did call the police but after an hour and a half without anyone responding we left.

Hi Bridget,

Parking lot accidents are some of the most difficult to determine liability. In most cases it will be determined to be 50/50 liability. This places blame equally on both parties. You should file your claim through your own insurance company. They will handle the repairs to your car and will deal with the other insurance company on determining liability and reimbursements.
