Auto Insurance Claims: Accident while under suspended license, driving on a suspended license, owi

My boyfriend was in an accident last night. The other car ran a red light and smashed into him. He currently does not have a license due to an OWI he recieved last month. He has no insurance either, because of this also. I know he shouldn't have been driving, but it still doesn't mean that she wasn't at fault. Does he have any grounds to get restitution for the damage done to his car? It's totalled.

Hi Melissa,

Your boyfriend is entitled to be fully compensated for all damages and expenses. He may be in trouble or receive tickets for driving on a suspended license and operating a vehicle with no insurance, however that does not take away the negligence of the other driver.

If they try to deny the claim or reduce the compensation, he should fight it.
