Auto Insurance Claims: Police Report A Factor In Determining Fault?, police report, different company

Question
Hi Bennie,

I have liability coverage with 21st Century. I was sick; asked my cousin to use my car to run errands for me. He is not on policy, does not live at same address, and had my permission to use my car that one day. Unfortunately, he was involved in car accident. A police report was filed but would not be avail until next week. 21st Century found him at fault after only 2 days of investigation and without the benefit of seeing police report. How much of a factor would the police report's findings play into this scenario? If the report agrees with 21st Century, would Michael receive any moving violations? Would my cost for insurance go up even if I have another vehicle insured with a different company? And if police report found that Michael was not at fault, what are my options to proceed?

Your time and input will be greatly appreciated. Thank you.

Answer
Hi Judy,
In over half of the accidents, it is possible for the insurance to make a determination of fault without a police report.
If the police report finds your cousin not-at-fault, 21st Century will have to back up real quick.
Your cousin's accident should have no affect on your rates.

In most states, a citation is not issued unless the police actually witness the accident, however, they will indicate on the police report that your cousin was in violation of certain sections of the state vehicle code.

I hope you find this information helpful.
