Auto Insurance Claims: Claim against Semi Insurance - Interstate Accident, drive shaft, leasing company


Question
While driving the Interstate in a construction zone - a semi lost it's drive shaft and it was laying crossways in the lane.  Me and two other cars hit the drive shaft and sustained damage to the drivers side front and rear tires as well as bending the rims.  Towing was required.  I contacted the Insurance Company number provided on the accident report and they referred me to the transportation company that the semi was pulling a trailer for (Priority Transportation).  The original insurance company (provided on the accident report) said they would not pay for it if he was pulling a trailer, (he was) so I called the leasing company.  I've been transferred all over and finally left a message for a claims area.

My question is do you have any advice on how to handle this?  Should I submit the claim also to my insurance company?  Am I going to have to pay the repair shop and pray to get reimbursed to get my car back?  Would this be covered under under-insured motorist if the trucking company refuses to pay my claim?

Hi Jill,

So far you have been successfull in getting to a claims department. What you do next will depend on what they do. If they accept liability, they should pay for the cost of repairs as well as your tow bill. If they deny liability you will have to either pay for the repairs out of pocket or file a claim under your collision coverage which would be subject to your deductible. This would not be an uninsured or underinsured motorist claim unless it was learned that the at-fault party did not have any insurance at the time of the accident.
