Auto Insurance Claims: Car Collision, small claims courts, defence attorney

Hi, I would first like to thank you for taking the time to helping me. To make things simple and short here is my dilemma...
July 1st 2008 I was driving straight in my lane and a women merged into my lane and hit my car, this took place near an intersection. This was my first accident so I didn't feel it was needed to call the police. Well a few days past and I hear from her insurance company claiming I was the one who supposedly hit her. My insurance is liabilty with no collision coverage and the woman's insurance have denied me of any payment for my damages. Next step I was told to take this case to small claims courts. I'm in the process of finding a witness that worked nearby who saw the accident but that person may not want to help. So I was wondering if there are specialist whom I cam take my car to analyze the damage and bring a written statement into court as evidence. What other evidence can I provide to strengthen my case? Can I get some advice? Thank you so very much.

Hi Josephina,

In most states you can not bring written statements into court as evidence. The actual person who would write the statement must be in court to testify in person. You should contact your insurance company to report the claim. They will also do an investigation and take statements from all drivers and make a liablility decision. If this does end up in court, your insurance company will provide you with a defence attorney.
