Auto Insurance Claims: Insurance co liablity from auto accident, car totaled, . Repair not total car

Question
My son was involved in a car accident on april 22 with no personal injury to him, but the car was totaled. The other operator was found 100 percent at fault. I am unclear on what the insurance company is obligated to pay.

Answer
Hi Andrew,

The company has to pay (up to the policy limits) all of the damages incurred as a result of the negligence of their insured.  These include property damage to the car and contents and personal injury suffered by your son, including medical costs, transportatiooon to doctors, wage loss, and pain and suffering and loss of enjoyment of life.

The following three pages from our website—Auto accident claims www.SettlementCentral.Com insurance injury claims taught—are not real detailed, but they have both a general introduction, and a listing of page topics within the website by which you can get some additional topics for you to research.  I would not advise joining our website UNLESS your son starts treating for injuries and has to make an insurance injury claim.

As for the car, here is some general introduction information on Auto Accident Damage http://www.settlementcentral.com/page0477.htm  Your Vehicle to be Totaled

If you like the ride, then do as some do: accept lesser or rebuilt parts to lower the cost of repairs to keep the vehicle.  Auto Accident Damage: http://www.settlementcentral.com/page0476.htm  Your Vehicle Repairable

And do not forget about any personal property that was destroyed.

I am more worried about your son's condition that losing a few hundred dollars on the fight over the value of the vehicle.  Kids do not admit to injuries, but you must monitor and be sure to have him let you know if he feels even a dull ache after a week or so.  Get to a doctor and start a treatment without fail since if you wait for it to go away, it may or may not.  And if the latter, then you will have lost some opportunity to make claim for his injuries should you wait too long.

DO NOT SETTLE YOUR  CLAIM UNLESS YOU ARE ABSOLUTELY CERTAIN THAT SOFT TISSUE INJURIES WILL NOT REAPPEAR ONCE HE STRESSES HIS BODY WITH PHYSICAL ACTIVITIES OR JUST DAILY LIVING AND WORKING.  That Plays Right Into an Insurance Tactic Regarding Inducing Early Settlement of Injury Claims.

Plus, who will pay for your medical care incurred AFTER he settles?  What if he were to settle now and nine months later when he is suffering at school or work, and the pain starts to become too much, and he went to his doctor only to discover that he can expect a course of treatment that will cost a lot of money?  After you settle his claim, all further treatment is YOUR responsibility. Except in specific, unusual situations, you cannot go back and re-open a settlement.

Here is page from my website that shows in detail why you should never make an early personal injury insurance claims settlement http://www.settlementcentral.com/page0211.htm

And, of course, once you settle, THAT IS IT: he will never see another dime in pain and suffering money.  By the way, did you know that getting an early settlement is a favorite trick of the insurance adjusters?  In case you did not open this page above, then please do so now to see our website wherein we show Insurance Claim Adjuster Secret Tactics http://www.settlementcentral.com/page0092.htm

So, when pain episodes happen, even if a couple months or more post-treatment, you should not hesitate to make your son SEE A DOCTOR AND ATTRIBUTE THE PAIN TO THE ACCIDENT WITHOUT EQUIVOCATION.  It is NEVER TOO LATE TO REPORT PERSONAL INJURIES FROM A FALL ACCIDENT http://www.settlementcentral.com/page0104.htm
