Auto Insurance Claims: Friends husband was in an auto accident without auto ins or a drivers license, insurance expert

Question
He was coming home from work an this mans foot slipped off the brake an he entered traffic hitting my friends husband. The man took full blame for everything and Corey my friends husband was not ticketed for no license, or even being at fault, but was ticked for no ins. Being that this happened in Wisconsin I thought that not havin a license (that was suspended) an no ins it's automaticly you fault. She said the geico specialist was looking at their car an it will be settled in no time! Great I think but now im wondering how? I'm very confused on whats going to happen if an when they find out he doesnt have one???  I'm worried my girlfriend will end up without a car or money to replace it. I know his ass shouldnt of been driving.....just wondering what you think of the situation. Thank you for your time.

Answer
Hello Holly,

Whether or not your friend's husband had a D/L and insurance is irrelevant to GEICO.  He's not their insured.  They simply owe him for the damages their driver caused.

Your friend's husband will have bigger problems with the state.  He will be penalized for driving without D/L, and they will find out at some point that he has no insurance if they don't know already.  Perhaps that is why his license is suspended ...

But these things do not matter in terms of the liability claim against GEICO.  Now if it was HIS insurance company, that would be a problem, and could result in a cancellation of his policy, but under these circumstances his problems are with the state, not GEICO.

And, no, not having a license does not automatically mean that an accident is "your fault".

Take care.
