Auto Insurance Claims: Uninsured Motorist Coverage, state insurance commissioners, uninsured motorist coverage

My car was totaled by a 20 year old (confirmed in the police report to be uninsured and no drivers license) The car was not his, but I got the DMV report confirming the car was also uninsured.  Wawanesa is refusing to honor my coverage because they say they are trying to recover what they paid for my car, prior to paying the deductible under my uninsured motorist coverage.

If you have a deductible on your uninsured motorist coverage then you have to pay it. However the deductible for uninsured motorist coverage is generally less that the deductible on you collision coverage. If they have already made you pay the collision deductible then you should demand that they show this as an uninsured motorist claim and reimburse you the difference in the two deductibles. If you have no deductible on your uninsured motorist coverage then they should reimburse you the entire deductible you paid.

If the insurance company refuses to do this you should file a complaint with your state insurance commissioners office.
