Auto Insurance Claims: Insurance Check, small claims court, legal obligation

Question
My car was damaged by a renegade sign in a business parking lot. $1,500 damage. The store offered to pay the body shop but not me. The car is not worth spending $1,500 on body work. What are my options?

Answer
Hi Rita,
You need to explain to the store that their legal obligation is to make a payment to you.
Tell them to either make the payment or you will take the case to small claims court and they will also be liable for the costs of court.
If they still refuse to make direct payment, then go ahead and file small claims court action.

I hope this information has been of help.
