Auto Insurance Claims: Rear-end accident, full size chevy, small claims court

I was at a complete stop waiting to turn left into my daughter's school when I was rear-ended. It was estimated that the teenager that hit us was going about 60-65 mph (have a witness that said my rear end came off the ground about 3 ft). My 2002 Tahoe took the crash very well ($6000 in damage) but his full size chevy truck was totaled. I got my Tahoe back from the shop last week. On the way home, I noticed that my car was pulling pretty good to the right and the driver seat back was bent towards the rear on the right side. I contacted the shop and the teenagers insurance (State Farm). I took it back to the shop this morning and got a call from State Farm this afternoon stating that they were not going to pay for a seat or alignment. They told me that it was normal wear and tear for a vehicle that is 6 years old and has over 100k miles plus a rear-end accident would not cause my vehicle to need an alignment. My vehicle is very well kept and most of my miles were from driving cross country when I was in the military. I went ahead and paid for the alignment and my vehicle still pulls to the right. I do not know what to do at this point. File a complaint with the state insurance commission, take them to small claims court, call my insurance company or what???

Hi Greg,
To me, it sounds like you have some frame damage.  This could cause a 'tweak' in the drivers seat and cause a problem with the alignment that can't be corrected until the frame damage is repaired.
After getting a complete frame inspection (at a different shop), If there is frame damage, you should call your own company to see if they can be of help.  You should also file a complaint with the department of insurance.

In the future, it will always be better to deal with your own company for repairs and have them to all the work to recover damages from the adverse company.

When dealing with your own company, the claim is never 'closed', so any related damage that shows later is covered.  Many companies will guarantee the work done for as long as you own the car.
