Auto Insurance Claims: Girlfriend totaled my truck possible suspended license, state insurance commissioners, commissioners office

My girlfriend totaled my 2007 4 runner 3 weeks ago and was cited as fault, her license shows "revoked" in the system for medical purposes although we have letters from both her doctor and DMV allowing her to take the road test last yr May and issued a new license, the DMV claims they sent a letter in Oct 07 revoking it but neither of us saw anything from them on the matter.

Intially the claims adjuster totaled the auto and gave me the letter to seek new SUV based on paying out the old truck but got a call Friday that I believe they may now dispute the pay out, not sure what to do? again I certainly would not let her behind the wheel if any idea of a revoked or suspension and with my company sending me the letter I would be on the hook fort two SUV's?

Hi Frank,

Unfortunately, this is a very complicated situation. When the state revokes a license, they are only required to mail you the notice. They are not required to make sure that you received it. However the revokation still stands.

You should keep the initial letter from the insurance company. Continue to deal with the insurance company untill you get a final disposition of your claim. If they deny the claim, you may want to contact you state insurance commissioners office to file a complaint. You may even need to talk to an attorney that specializes in insurance companies denying coverage.
