Auto Insurance Claims: insurance lapsed, frontal damage, insurance comapny

Dear Mr. Hixenbaugh,
   My name is Cindy & on 03/10/2008 i was involved in a 2 vehicle accident. I waited in the middle of the intersection to make a left turn. Before i proceeded to make my left turn, there was a car that was going north which i yielded the right of way. As that vehicle passed by i then felt it was safe to complete my turn as the traffic light was in my  favor changing to red. Little to my knowledge someone was speeding to run the light as i started making my left & struck me with frontal damage  which i was accompanied by my 3 month old daughter. Shortly after i contactedmy insurance agent which advised me that my policy was canceled. I had previously sent out a payment & received a receipt of payment but in no way was  aware of my policy being canceled until that day. I need to know what rights i have in this matter.

Hi Cindy,

If you have proof of the date of mailing, then you may be able to have coverage. There is no grace period in auto insurance. If the payment is late, the insurance comapny sends out a cancellation notice. If the payment is not received prior to the cancellation date, the policy is no longer in effect. You will need to have a post office receipt showing the date and time or some other proof that the payment was made prior to the cancellation date.
