Auto Insurance Claims: Insurance company delay, insurance adjuster, own insurance

I was involved in an accident 4 weeks ago , it was a 2 lane one way street , I was in the left lane the other driver was in the right lane , he decided to make a left turn from the right lane and hit the passenger side of my car, I filed my claim through the other drivers insurance and their adjuster came out 2.5 weeks ago and I faxed them the police report 3 weeks ago, I called up after 2 weeks after not hearing from the insurance  company. I asked them whats the status on my claim and they said theyre still waiting for a written statement from the other driver. The other driver is clearly not responding because he was at fault and is trying to delay , is there anything I can do or tell the insurance company to speed up the process so i can finally fix my car

Most stated require that a claims be investigated and either paid or denied within 30 days of reporting it to them.

You could try sending a certified letter to the at-fault person telling them that if they do not cooperate to get the claim paid that you will file a law suit against them personally. You could also suggest to the insurance adjuster that instead of a written statement that they call him and take a recorded statement over the phone.

The only other option is to file the claim on your own insurance and let them fight it out with the at-fault persons insurance.
