Auto Insurance Claims: LIability on private property, ohio thanks, comparative fault

Hi,

I was recently backed into on my university's campus by another driver.  I was at a stop sign coming out of a parking lot and she backed into my stopped vehicle.  I filed a report with campus police and the defendant wanted to settle "without insurance".  Needless to say, she didn't like the $500 repair bill and is trying to say that because it was on private property, despite her negligence it is my obligation to fix my car.  IS this at all accurate?  I have no record of comparative fault or what not but I believe since i was stopped at a stop sign behind the stop line when she struck me it would be 100% her 0 me.  Is there any such private property restriction?  I am in Ohio.  Thanks for your advice!

Hi Tom,

You are correct. The other driver is 100% at fault and is responsible for paying for your damage. Any time someone hits a stationary object they are at fault. There is no such exemption for an accident occuring on private property that would obsolve the other persons liability or responsibility to pay.
