Auto Insurance Claims: How much will the insurance spend, uninsured motorist coverage, wage garnishment

I was in wreck 6 months ago we where both injured and the other party was found at fault by the chp. I have full coverage and the other party is uninsured. My policy limit is $25000 he is suing for more than the limits. How much will the insurance spend to defend me. I was not going to sue because he has no assets. Will a counter suit help or am I throwing good money after bad.

Hi Bob-

If the CHP found the other driver at fault, I don't think he has much of a case unless there are other things that may be questionable.  Your insurance company should help you determine who is responsible.  Your uninsured motorist coverage should pay for your injuries and the damages to your car.  

Your insurance company will defend you up to the policy limits of $25,000.  After that you will need to find an attorney on your own to fight against losing assets or possible wage garnishment if you lose the case.
