Auto Insurance Claims: hit and run, car theif, small claims court

Question
My car was parked on private property and subsequently hit by another vehicle. i was able to identify the vehicle license plate number and the police later located the vehicle. the owner reported the car as stolen but only after about 5 days passed between the accident. this vehicle of mine is one that i don't drive or carry insurance on and the insureds agent says that they have no liability. What ca i do??

Answer
Hi Charles-

If you can provide evidence that the owner was driving or allowed someone else to drive it you could take it to small claims court.
Without that he is right- insurance companies do not pay when a stolen car causes damage.  The car theif is the one responsible and if you could identify him you could sue him.

Other than that I guess you can chalk this up to a learning experience that just becasue you are not driving a car doesn't mean you don't need insurance on it.
